Your privacy is important to us. Maintaining your trust and confidence is one of our highest priorities. We ensure secure transactions and strive to take reasonable care in the protection of information we receive during the course of us rendering services and / or your use of any of our products.

IHX Private Limited, is a company registered under the Companies Act, 2013, with CIN U72900KA2020PTC138527 and having its registered office at No. 9, Shendge Avenue 1st Floor, 2nd Street, Kamaraj Road Bengaluru, Karnataka 560042 (hereinafter referred to as "We", "Our", “IHX” or "IHX Private Limited", which expression(s) include IHX's current and future affiliate entities). We own / or and operate the IHX Tools (defined below) and are committed to protect the privacy and security of personal data or personal information belonging to and / or shared by all users of the IHX Tool(s) ("User", “user” "You", “you” “Your” or "your"), either directly or indirectly through any person duly appointed on your behalf, including, any 'Consent Manager', lawful guardian, Providers, care seekers, patients, Payers, or parents. We value Your privacy as well as personal data, and advise You to carefully read this privacy policy ("Privacy Policy" or “Policy”) as this Privacy Policy describes the types of personal data or personal information we collect, how we use the information, how we process and protect the information we collect, for how long we store it, with whom we share it / disclose it, to whom we transfer it and the rights that individuals can exercise regarding our use of their personal data. We also describe how You can contact us about our privacy practices and to exercise your rights.

This Privacy Policy may be subject to further changes including as may be warranted by change in any Applicable Laws. Upon updating the Policy, we may revise the “Updated” date at the bottom of this Policy. We therefore request you to go through our Privacy Policy frequently to be updated with changes incorporated from time to time. Your continued engagement with us will imply your acceptance of such updates to this Policy.

Defined Terms

“Applicable Laws” means, in relation to this Privacy Policy and with respect to any person, any binding, state, national or local statute (including the Digital Personal Data Protection Act, 2023 (at the time in effect), law, ordinance, notification, rule, regulation, order, writ, injunction, directive, judgement or decree, or other requirement of any Governmental Authority and / or Governmental Approval(s) applicable to such person or any of their respective properties, assets, officers, directors, employees, and consultants at the relevant time

“Governmental Approval(s)” means any permission, approval, consent, license, permit, order, decree, authorization, registration, notification, exemption or ruling to or from or with any Governmental Authority.

“Governmental Authority” means any relevant and / or applicable government or any province, state or any other political subdivision thereof, any entity, authority or body exercising executive, legislative, judicial, regulatory or administrative functions of or pertaining to government, including any government body, agency, department, board, commission or instrumentality of India, or any political subdivision thereof, or of any other applicable jurisdiction, any court, tribunal or arbitrator, vis-à-vis this Privacy Policy.

“IHX Tool(s)” as used within this Privacy Policy shall refer to website, IHX Platform(whether accessed through a computer system, mobile device or any other form), the mobile application 'IHX HealthBank', which is available on Google Playstore and / or other interfaces including software, programmes, web application , etc., developed, owned, controlled, operated and / or licensed by IHX on which personal data is collected. It includes all past and present versions of the platform owned, developed (in part) and controlled, including under any other name, by IHX and subscribed by you to submit / exchange / process / receive the necessary patient, medical, billing, KYC or any other healthcare related information and integrate with third party payer systems. For clarity, the term “IHX Platform” as specifically used within provisions of this Privacy Policy, is intended to cover and / or refer to only the users of the IHX Platform vis-à-vis such specific provisions.

“Payer(s)” here refers to insurance companies and third-party administrators with whom We have an Agreement with. In the event that We have an Agreement with the same Payer(s), We may receive information about your organization or users of your IHX Platform account from the Payer(s). This will be governed by the agreement between you and the Payer(s), IHX and the Payer(s) along with the End User License Agreement accepted by you for using IHX.

"Personal data”, “personal information”, “data” and / or “personal data” (and any grammatical connotations thereto) means any information that relates to You and/or Your family members and/or Your dependents and may include date of birth, employee code, email address, residential address, mobile number, alternate telephone number, Government IDs (Aadhaar, PAN, VoterID, DL or any other) etc. and includes “Sensitive Personal Data or Information” (defined below).

“Sensitive Personal Data or Information” shall include, subject to Applicable Laws for the time in effect, information which consists of information relating to -

  • financial information such as bank account or any other payment instrument details;
  • physical, physiological and mental health condition;
  • medical records and history;
  • medical insurance details
  • any detail relating to the above clauses as provided to body corporate for providing service;
  • any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise:
  • video and audio files present / uploaded on / uploaded from the User device for the purposes mentioned within this Privacy Policy and / or the Terms of Use; or
  • geographical location and tracking of the User device vis-à-vis any IHX Tool(s),

and other such information that You share with Us whether directly or in combination with other information or is received from a Third-Party Service Provider, that personally identifies You or could be used to personally identify You. Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other Applicable Laws for the time being in force shall not be regarded as personal data or Sensitive Personal Data or Information.

“Services” shall mean the relevant services being availed by you by accepting any relevant Terms of Use vis-à-vis the relevant IHX Tool(s) and / or rendered by IHX pursuant to your utilization, installation, download, access and / or usage of any IHX Tool(s).

"Terms of Use” shall mean the relevant terms and conditions, End User Licensing Agreement (in connection with the IHX Platform) or other agreement duly accepted by the User vis-à-vis the relevant IHX Tool(s) for the purposes of availing the relevant Services under such IHX Tool(s).

"Third Party Service Providers” shall mean Payers, Healthcare Providers, laboratories, pharmacies, healthcare network and / or any third parties engaged by IHX for the purposes of rendering any part and / or component of the Services and processing data and / or other information on behalf of IHX under lawful contract or otherwise appointed for the improvement and administration of the IHX Tool(s).

You expressly agree that You have acceded to the terms of the Privacy Policy. Your use of the IHX Tool(s) / Services (for the scope set out within Your relevant Terms of Use) or any personal data shared by You are subject to the terms of this Privacy Policy and IHX's Terms of Use wherein You have provided Your free, specific, informed, unconditional and unambiguous consent with clear affirmative action for the purposes specified herein and therein. In the event You do not wish to be bound by these terms, You have a choice, which is free from any form of coercion or undue influence, to not access the IHX Tool(s) or to withdraw Your consent to share Your personal data, in accordance with steps provided within the Terms of Use and / or this Privacy Policy. This Privacy Policy also applies generally to Our parent, affiliates, subsidiaries, or joint venture websites (if any).

1. YOUR CONSENT

We request You to carefully read this Privacy Policy and Terms of Use of the IHX Tool(s) before sharing personal data with us. This Privacy Policy applies to current and former users of the IHX Tool(s). By visiting and/or accessing the IHX Tool(s) (or searching for any of the pages on any IHX Tool(s)), You explicitly consent and agree to the Privacy Policy laid out herein and by providing Us with Your personal data yourself or any authorised person on your behalf, or by making use of the Services provided through the IHX Tool(s) or through Third Party Service Providers (as defined under the Terms of Use), You hereby acknowledge for the collection, receipt, storage, use, processing, disclosure and transfer, whether directly or indirectly, of Your personal data in accordance with the provisions of this Privacy Policy as well as the Terms of Use of the IHX Tool(s) and the purposes set out herein and / or therein.

You acknowledge and understand that no liability pertaining to the authenticity / genuineness / misrepresentation / fraud / negligence, etc. of the information disclosed shall lie on IHX, nor will IHX in any way be responsible to verify any information / personal data obtained from You.

Collection, use transfer, processing and / or disclosure of information which has been designated as 'Personal Data' under the relevant Applicable Laws which require express consent of the User. By affirming Your assent to this Privacy Policy, You provide Your consent to IHX for such use, collection and disclosure, to any third parties lawfully and contractually engaged with Us, for the provision of Services vis-à-vis any of the IHX Tool(s) or otherwise.

Personal Data of Users: Whenever you visit / use the IHX Tools, we, as well as any third-party advertisers and / or Third Party Service Providers, may use a variety of technologies that automatically or passively collect information about how the IHX Tools is accessed and used. We may collect information such as Your name, address, email, phone number, medical records and medical history, physical, psychological and mental health condition, KYC details, payment and billing information such as credit card information, bank account numbers and other such information as provided by You while rendering Services vis-à-vis the IHX Tool(s), upon your registration / sign up to use any of the IHX Tool(s) and / or making any payments for the Services or use of Our IHX Tool(s) . We may also collect information that You share in the process of User registration, post in Your feedback, reviews, comments etc., on the IHX Tool(s).

Non-Personal Information: Information, (viz. type of internet browser and operating system used, domain name of the website from which You came, number of visits, average time spent on the site, pages viewed etc.) may be picked up automatically and without being explicitly provided by You, but during Your interaction with the IHX Tool(s) by the use of certain technologies, such as cookies and web beacons.

We will be using Google Gmail, read only permission to sync your health records from multiple sources to IHX HealthBank.

IHX's use and transfer to any other app of information received from Google API's will adhere to the Google API Services users data policy, including the Limited Use requriements

Camera & audio permissions are required to facilitate a tele consultation with doctors & save medical records with IHX Tools. The doctor might choose to record the tele consultation for medico-legal reasons. We will inform you on the tele consultation screen if the doctor chooses to record the video consultation session.

We additionally seek permission for reading & writing files on external storage to allow you to upload & save medical records on IHX HealthBank application which you have full control over whether to share further with doctors or not.

We don't scan any other files from your storage system other than the files you're explicitly uploading.

We require permission to use images / videos or capture images / videos from a camera for updating profile photos, uploading images as medical records, accessing the User’s geographical location and / or co-ordinates or measuring heart rate using Camera.

We shall only save images or Videos where the user explicitly chooses to save images or videos with any IHX Tool(s) and such images or videos may be accessible by any Third Party Service Provider authorized / permitted to have access to such images or videos.

We require access to camera, Images and file upload in order to inter alia:

  • Store medical records;
  • Update user profile photo;
  • Capture heart pulse rate; or
  • Capture location data and surroundings through video

The user Images can only be saved on the IHX HealthBank Application by an explicit action of the user.

Third Party Integrations: You may connect third party integrations to your IHX account, which may ask for certain permissions to access data or send information to your IHX account. It is your responsibility to review any third-party integrations you authorize.

Any permission(s) granted by you, grants these third parties access to your data, which may include (but is not limited to) granting third-party applications access to view, store, and modify your data on IHX. We are not responsible for the practices of third-party integrations, so please carefully review the permissions you grant to third-party applications.

We will be using Google Gmail, read only permissions to sync your appointments and medical records from multiple sources to IHX HealthBank. We automatically collect your IP address or other unique identifier (“Device Identifier”) for the Device (computer, mobile phone, tablet or other device) you use to access the IHX Tool(s). A Device Identifier is a number that is assigned to your Device when you access the IHX Tool(s) or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Services, help diagnose problems with our servers, analyze trends, track users web page movements, help identify you and your interests, and gather broad demographic information for aggregate use.

The technologies used on the IHX Tools to collect personal data and Non-Personal Information (including Device Identifiers), include but are not limited to: Cookies (data files placed on a Device when it is used to visit the IHX Tools), mobile analytics software and pixel tags (transparent graphic image, sometimes called a web beacon or tracking beacon, placed on a web page or in an email, which indicates that a page or email has been viewed). Cookies may also be used to associate you with social networking sites like LinkedIn, Facebook and Twitter and, if you so choose, enable interaction between your activities on the IHX Tools and your activities on such social networking sites (for clarity, this Privacy Policy does not apply to these features and your interactions with these features are governed by the privacy policy and other policies of the companies providing them). We, or our vendors, may place cookies or similar files on your Device for security purposes, to facilitate site navigation, to perform analytics, and personalize your experience while visiting our IHX Tools (such as allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location, or demographic information). A pixel tag may tell your browser to get content from another server.

IHX's use and transfer of any personal data or Non-Personal Information to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the 'Limited Use' requirements.

As applicable to a IHX Platform User, You may update, collect and manage personal data when using the IHX Platform or any other IHX Tool(s). IHX processes such data as a processor under your direction. You, as data controllers, are responsible for complying with any regulations or Applicable Laws that require providing notice, disclosure, and / or obtaining consent prior to You collecting any personal data using the IHX Tools.

3. INFORMATION WE RECEIVE FROM THIRD PARTIES

We may receive information about you from third parties such as consumer or other reporting agencies and medical or health care providers; or through your interactions with our affiliated companies. In addition, if you are on another website and you opt-in to receive information from us, that website will submit to us your email address and other information about you so that we may contact you as requested. You may also choose to participate in a third-party application or feature (such as one of our LinkedIn, Facebook or Twitter applications or a similar application or feature on a third-party website) through which you allow us to collect (or the third party to share) information about you, including usage information and personal data such as lists of your friends, “likes”, comments you have shared, groups and location. Services like LinkedIn, Facebook Connect give you the option to post information about your activities on our IHX Tools to your profile page to share with others within your network. In addition, we may receive information about you if other users of a third-party website give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections'” web page, profile page, or similar page on a social networking or other third-party website or interactive service. We may supplement the information we collect about you through the IHX Tools with such information from third parties in order to enhance our ability to serve you, to tailor our content to you and / or to offer you opportunities to purchase products or services that we believe may be of interest to you.

4. COOKIES

We use data collection methods / mechanisms such as “Cookies” on certain pages of the IHX Tools to help analyze our web page flow and promote trust and safety. “Cookies” are alphanumeric identifiers with a small amount of data that is stored on the User's device hard-drive containing information about the User, commonly used as an anonymous unique identifier. We offer certain features that are only available through the use of “Cookies”. We also use “Cookies” to allow you to enter your password less frequently during a session. Most “Cookies” are “Session Cookies”, meaning that they are automatically deleted from your hard drive at the end of a session. IHX and other Third Party Service Providers collect information about You using these Cookies. Please note, a Cookie in no way gives Us access to Your device. IHX Tool(s) use these "Cookies" to collect information and to improve Our Services. Some Cookies and other technologies may serve to recall personal data previously indicated by You. Most web browsers are set to accept cookies by default. If You prefer, You can usually choose to set Your browser to remove cookies and to reject Cookies. If You choose to remove Cookies or reject Cookies, this could affect certain features of the IHX Tool(s) hence, we recommend strongly that you allow them to ensure you have access to all of our Services.

5. PURPOSE OF USING, COLLECTING, PROCESSING, DISCLOSING AND / OR TRANSFERRING PERSONAL INFORMATION

We would like to state that we collect personal data that is absolutely necessary and relevant for us to make your experience hassle-free, convenient, smooth and most importantly, safe. This will also help us in providing you with customized services, assist you with all your queries, resolve the issues faced by you, to follow up with you in order to ensure a long, sustained relationship and most importantly to safeguard you from any kind of fraudulent and unlawful usage. Personal data may be collected by us directly from you and/or your family members and / or your dependents for the purpose of providing inpatient and outpatient services.

IHX allows you to, among other things, manage cashless health insurance claims across all Payer(s). When you use the Platform, you may enter Personal Data such as first and last name, email address, physical address, phone number, medical information, KYC or other information about you. We do not control the content of the data you enter on the IHX Tools outside the validation logics if any. We store the information entered by you on our service providers’ servers but process it as a processor under your instructions and in accordance with our End User License Agreement and / or Terms of Use.

You control and are responsible for entering or updating the information you process using IHX Platform and for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to transferring the personal data to IHX for processing purposes.

You agree and acknowledge that all information gathered from You, that is, information that is voluntarily provided by You or received from Third Party Service Providers and information that may be automatically collected, may be used by IHX for the following purposes:

  • to comply with any Applicable Laws that require disclosure;
  • to respond to Governmental Authorities, including law enforcement officials, or pursuant to judicial orders, subpoenas, injunctions or other process;
  • to avert a serious threat to health or safety;
  • to enable the provision of Services opted by You including collating all User medical records, reports and other data;
  • to provide general statistics regarding use of the IHX Tools. For these purposes, we do link this automatically-collected data to other personal data such as name, email address, address, and phone number. We also use log files to troubleshoot and investigate security incidents;
  • to enable the viewing of content in Your interest;
  • to include social media features from Facebook, Instagram, LinkedIn etc. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our IHX Tools. This Privacy Policy does not apply to these features. Your interactions with these features are governed by the privacy policy and other policies of the companies providing them;
  • to copy, reproduce, store, distribute, publish, export, adapt, edit and translate personal data to the extent reasonably required for the provision of Services by IHX;
  • send you push notifications from time to time in order to update you about events and promotions. If you no longer wish to receive such communications, you may turn them off at the device level;
  • to provide better products and Services and to programmatically use Your data to give You contextual Services;
  • to fulfil Your requests for certain Services;
  • to contact You about Our Services;
  • to facilitate of end-to-end claims management by Payer(s);
  • to include the anonymization of data, conversion of unstructured data into a usable, structured format;
  • for providing services relating to contract management;
  • for providing any additional services;
  • to use and share Your information with Third Party Service Providers or other third parties with whom We have contractual relationship. For example, We may provide You with a link where You may share Your content with another person including a Third Party Service Provider;
  • to respond to Your comments, reviews and questions and provide better customer service;
  • for promotion and marketing purposes;
  • to track Your activity on Our digital platforms and personalise and improve Your experience;
  • to understand Your preferences and to enhance, personalise, and customise Your experience using IHX Tool(s);
  • to conduct research following internal review protocols to ensure the balancing of privacy and to use anonymised data for research. Additionally, any Non-Personal Information which is exclusively owned by IHX may be used in an aggregated or non-personally identifiable form for internal research, statistical analysis and business intelligence purposes including those for the purposes of determining the number of visitors and transactional details, and IHX may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or Non-Personal Information to Third Party Service Providers, other third parties and / or Our affiliates;
  • to use Your information to operate, improve and maintain Our IHX Tool(s), to prevent fraud, identity theft and / or any form of abuse of Our Services;
  • to enable Us to improve Our IHX Tool(s) in a continuous and on-going manner so that IHX is inter alia able to render the Services more efficiently and / or make enhancements to the Services and user interface of Our IHX Tool(s);
  • to fulfil any other purpose for which You provide Us personal information; and
  • for any other purpose for which You give Us authorisation.

Please note that We may use Non-Personal Information created by Us without restriction. We may retain Non-Personal Information and will continue to use Non-Personal Information as permitted under this Privacy Policy and any Applicable Laws in effect.

6. TRANSFER AND / OR DISCLOSURE OF PERSONAL INFORMATION

We may disclose personal data that we collect from You or that You provide

  • to contractors, service providers, Third Party Service Providers and / or other third parties for analytics and communications and who are bound by contractual obligations with Us to keep personal information confidential;
  • to such other persons as are required for Us to render the Services or by any Applicable Law and / or any relevant Governmental Authority, which inter alia can include providing personal data as required by a court order;
  • when we believe in good faith that disclosure is necessary to protect Your safety or the safety of others, to protect Our rights, to investigate fraud, or to respond to the request or directions of an appropriate Governmental Authority;
  • to a buyer, subsidiary, or other successor and / or permitted assign to the Terms of Service of the IHX Tool(s) in the event of a merger, divestiture, restructuring, reorganization, dissolution, acquisition or other sale or transfer of some or all of IHX’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, pursuant to which personal data maintained by the IHX Tool(s) is amongst the assets transferred;
  • for any other purposes disclosed by Us when You provide the personal data;
  • to deal with requests, enquiries, complaints or disputes and other customer care related activities including those arising out of the Users’ request of the Services and all other general administrative and business purposes;
  • with your employer or its authorized representatives, if applicable, and on receipt of a formal request from your employer and upon receipt of necessary approval(s);
  • your authorized representatives, if applicable, and on receipt of a formal request from your organization and upon receipt of necessary approval(s);
  • with our empanelled healthcare ecosystem participants on a need-to-know basis for the purpose of enabling IHX to provide the necessary services to you. We may employ other Third Party Service Providers to provide the Services (or any part of the Services thereof) on our behalf to you on the IHX Platform. We may need to share your information with service providers to provide information about products or services to you. Examples may include providing customer service or support, notification services through chat to you / your customers or any other necessary services to you. The data will be shared on a ‘need to know’ basis and these Third Party Service Providers are prohibited from using your personal data except for the specific purposes they are engaged in, and they are required to maintain the confidentiality of your information. In all cases where we share your information with such agents, we explicitly require the agent to acknowledge and adhere to our privacy and data protection policies and standards. For clarity, any permissions(s) granted by you to IHX, grants these Third Party Service Providers (by way of transfer, disclosure or otherwise) to your data, for the purposes provided herein.
  • to any Governmental Authority to the extent required (i) under any Applicable Laws or under orders of any relevant judicial or quasi-judicial authority; (ii) to protect and defend the rights or property of IHX; (iii) to fight fraud and credit risk; (iv) to enforce IHX's Terms of Use (to which this Privacy Policy is also a part); (v) when IHX, in its sole discretion, deems it necessary in order to protect its rights or the rights of others; and (vi) if otherwise required by any Applicable Law for the time being in force, for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences.
  • IHX may make User information / data accessible to its Third Party Service Providers, employees and data processors only on a need-to-know basis. All IHX employees, Third Party Service Providers and data processors, who have access to, and are associated with the processing of User information, are obligated to act in adherence with confidentiality and reasonable security measures.

Location Data Usage: We use location data only to show you relevant results for showing relevant results for booking appointments with the nearest healthcare facility, medicine delivery, lab report booking, finding blood banks & vaccination slots. Any such location data shared with you may be shared with Third Party Service Providers for rendering Services or otherwise as may be permitted under this Privacy Policy or Terms of Use for IHX Tool(s).

7. GOOGLE ACCOUNT EMAILS (GMAIL)

A User (HealthCare Provider/ Doctor/ CareSeeker) may choose to provide explicit consent to connect/integrate the User’s Gmail account(s) with his / her account on the IHX Tools). The following information will be collected from Your consented email accounts:

  • Consultation appointments taken with a Doctor / HealthCare Provider where the consented email account is owned by the Doctor / HealthCare Provider.IHX Tools organizes this information in your account to help you manage all your appointments at one place.
  • Medical Records, Lab Test Reports, Care Context Documents.IHX Tools organizes this information in your account to provide Smart Health Reports.

Connecting your Gmail account enables us to automatically provide updated Smart health insights to CareSeeker. IHX Tools cannot make any medical diagnoses. Please consult a doctor if you are concerned about your health or you have any medical queries. You should never override or reject a doctor's professional advice in favor of any information that you see on the IHX Tools

You can choose to de-link your Gmail account with the IHX Tools at any time and/ or you can delete your information by writing to support@ihx.in

Once connected, the IHX Tools will securely access and analyze the contents of emails consisting of ‘read-only’ including but not limited to the attachments from HealthCare Providers / Doctors for the purpose of managing and tracking Appointment information and/or Medical Records, such as Lab Reports, Prescription, Radiology Reports, Discharge Summary and consolidating this information in the User's IHX account .

Generic Mailbox Connection (Non-Gmail): If you connect your mailbox to IHX through entering the email ID and the password/app password (Generic Inbox Connection), we will use the data to send an email on your behalf based on the information entered by you. We may also read specific responses received on your email (from email IDs specified / confirmed by your users) through the mailbox connection which will be used for the purpose of updating the IHX Platform for your consumption. You will be able to remove the Gmail integration or generic mailbox connection at any time on the IHX Platform.

Please note that any data obtained by this integration will be used by IHX only for (i) providing the Services, (ii) updating the User’s Smart Health Reports, and (iii) consolidating appointments for a HealthCare Provider / Doctor in one location. We shall not use or transfer any data or information received from the integration of the email addresses with the account on the IHX Tools to third parties for any purpose other than as explicitly authorized by the User under the Terms of Use and / or the provisions of this Privacy Policy.

8. DATA STORAGE AND RETENTION

All your personal data is hosted and/or processed by us securely at Google Cloud Platform (GCP) and Amazon Web Services data centres situated at Mumbai and New Delhi, India or at such location(s) in India as the Company may desire to store.

We secure the personal data you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. All personal data is protected using appropriate physical, technical and organizational measures and is in compliance with Applicable Laws.

Your and / or your family members and/or your dependents’ personal data is retained by us only for the purpose of providing the required Services or for historical or statistical or legal purposes and such retention shall be for a period as required under Applicable Law.

We retain personal data that you provide to us where we have an ongoing legitimate business need to do so (for example, as needed to comply with our legal obligations, resolve disputes and enforce our agreements).

When we have no ongoing legitimate business need to process your personal information, we securely delete the information or anonymize it or, if this is not possible, securely store your personal information and isolate it from any further processing until deletion is possible. We will delete this information at an earlier date if you so request.

The data you process in connection with (i) the IHX Platform, is retained according to IHX End User License Agreement; and / or (ii) any other IHX Tool(s), is retained according to the relevant Terms of Use thereto.

Your security is important to Us. IHX adopts reasonable security practices and procedures to include, technical, operational, managerial and physical security control measures in order to protect all User information including personal data in its possession from loss, misuse and unauthorised access, disclosure, alteration and destruction, as well as adheres to all standards, reasonable security measures / safeguards prescribed under Applicable Laws, at the time in effect, for collection, storage, disclosure, transfer and / or processing of User data.

All data, content and / or all User information is encrypted during transmission and will be stored encrypted at-rest. IHX shall take reasonable steps to protect Your personal information in an effort to prevent loss, misuse, unauthorised access, disclosure, alteration, and destruction of the same.

IHX assumes no liability or responsibility for disclosure of Your personal information due to errors in transmission, unauthorised third-party access, or other causes beyond its control. IHX has undertaken reasonable security measures / safeguards, prescribed under any Applicable Laws, to protect Your rights of privacy with respect to Your usage of the IHX Tool(s) controlled by Us and Services provided herein. However, You acknowledge and agree that We shall not be liable under the Terms of Use, this Privacy Policy, under Applicable Laws or otherwise for any unauthorised or unlawful disclosures of Your personal information made by any third parties who are not subject to Our direct and immediate control.

10. CONFIDENTIALITY

You further acknowledge that the IHX Tool(s) may contain information which is designated confidential by Us and that You shall not disclose such information without Our prior written consent. Your information is regarded as confidential and therefore, will not be divulged to any third party, unless if legally required to do so to the appropriate authorities or shared as per this Privacy Policy or Terms of Use.

We will not sell Your personal information to any third party or use Your e-mail address for unsolicited mail. Any emails sent by Us will only be in connection with the provision of agreed Services, and You retain sole discretion to seek for discontinuation of such communications at any point of time by sending an email to support@ihx.in captioning Your such request.

11. USER'S RIGHTS

All the information provided to IHX by a User, including personal information, is voluntary. The User has the right to withdraw consent at any time, in accordance with the terms of this Privacy Policy and the Terms of Use by sending such withdrawal request to IHX at support @ihx.in, but please note that withdrawal of consent will not be retroactive i.e., We cannot delete the personal information for which We are custodians on behalf of Third Party Service Providers. Further, if a Third Party Service Provider ceases to be engaged with IHX, We may be contractually obligated to give such Third Party Service Provider a data export, however, given the nature of data, User may continue to co-own such data and IHX will continue to keep the personal information for continuous provision of services to the user.

Users can access, modify, correct and delete the personal information. However, if the User updates his/ her/ its information, IHX Health may keep a copy of the information which User originally provided to IHX Health in its archives for User documented herein. In case the User seeks to update or correct his/ her/ its personal information, the User may exercise these rights by emailing support@ihx.inand communicate the change(s) for updating IHX Health’s records.

If a User, as a casual visitor, has inadvertently browsed any other pages any IHX Tool(s) prior to reading the Privacy Policy and the Terms of Use, and such User does not agree with the manner in which such information is obtained, stored or used, merely quitting this browser application should ordinarily clear all temporary cookies installed by IHX. All visitors, however, are encouraged to use the "clear cookies" functionality of their browsers to ensure such clearing / deletion, as IHX cannot guarantee, predict or provide for the behaviour of the equipment of all the visitors of the IHX Tool(s).

If a User has inadvertently submitted any personal information to IHX prior to reading the Privacy Policy and Terms of Use, and such User does not agree with the manner in which such information is collected, stored or used, then such User can ask IHX, by sending an email to support@ihx.incontaining the rectification required, whether IHX is keeping personal information about such User, and every User is also entitled to require IHX to delete and destroy all such information relating to such user (but not other Users) in its possession.

In case User does not provide its information or consent for usage of personal information or subsequently withdraws consent for usage of the personal information, either directly or vis-à-vis any third person duly authorized by the User (including any Consent Manager recognised under Applicable Laws at the time in effect) so collected, IHX reserves the right to discontinue Services for which the said information was sought.

12. OPT OUT

IHX may send You certain notifications regarding promotional offers, marketing offers or regarding the Services being availed by You etc. In case You do not wish to receive them, You may have an option to opt out of the same.

If You opt out, IHX or its affiliates consents to not send any non-essential (promotional, marketing-related) communications to You, however, We may still send You non-promotional emails, such as emails about Your account. Your opt-out request will be processed within 10 business days of the date on which we receive it.

You control your personal data that you provide to us on the IHX Tools, but some personal data is required by us in order for you to obtain services from us or for you to use the IHX Tools. If you choose not to provide us with your personal data on the IHX Tools, you may not be able to take advantage of some of the Services we offer or use some functionality on the IHX Tools. Except as provided above, we will not share personal data collected on the IHX Tools with third parties without your consent.

If you wish to modify, verify, correct, or delete any of your personal information collected through the IHX Tools, you may edit your registered user information or contact us at grievance.officer@ihx.in In accordance with our routine record keeping, we may delete certain records that contain personal information or Information you have submitted through the IHX Tools. It may not always be possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons. We will retain your information (including geo-location data) for as long as your account is active or as needed to provide you Services. If you wish to cancel your online account or request that we no longer use your information to provide you services through the IHX Tools, you may contact us, we will retain and use your information as necessary to comply with our legal obligations, partner or other customer commitments who might be other party to the transactions, resolve disputes, comply with our internal compliance and record retention policies, enforce our agreements, carry out legitimate business functions, and for any other purpose permitted by Applicable Law. We do not control certain privacy settings and preferences maintained by our social media partners like LinkedIn, Facebook and Twitter. If you wish to make changes to those settings and preferences, you may do so by visiting the settings page of the appropriate social media site.

13. AMENDMENT

IHX reserves the right to amend the Privacy Policy, as and when required. It is Your responsibility to keep yourself updated of the changes made from time to time. Your continued use of the IHX Tool(s) shall be deemed to be Your acceptance of such changes.
